Today DH went to Winn-Dixie. They had Brisket on sale at a real good price. (Fri., Sat., Sun. only) There wasn't any in the counter. He asked the butcher. The butcher said they did not have any. They have not had any for quite a while. Not in the last 4 or 5 deliveries. DH went to the front desk and asked for a rain check. They said they don't give out rain checks. This was DH 4th or 5th time that he has had this happen.

My question is........are they breaking the law with false advertising?
 
Look in the fine print of the ad. If it says no rain checks they're within their rights. If it doesn't I don't believe they are.

My uncle did 3 years in San Quentin for advertising sale-price pork chops that weren’t in stock. I told him to put “no rain checks“ in the ad, but the newspaper charged by the word and he cheaped out.

He paid a dear price in the long run. Penny wise, pound foolish.
